Interesting post.
A few thoughts.
First, why is identity theft up? Awareness of it is also up, and Congress and states have taken some steps, as has industry. Why can't it be curtailed? The truncation of credit card numbers was supposed to have had an effect. Has it? Is there any way to know?
Second, perhaps the provision you discuss was sort of mindless, not an attempt by Congress to do something meaningless and tell constituents otherwise, but just a failure to appreciate how meaningless it was.
Third, in that regard, do you have any idea what the purpose of Federal Rule of Appellate Procedure 3(c)(1)(C) is? I can't figure out how it can possibly help anyone. Is it just mindlessly a part of the law with no real function, even though it is supposed to serve a notice function of some kind?
